Right of Handicapped Students to an Education

Your child, if handicapped, is entitled to an education as are all children. This right for an appropriate and effective special education program is guaranteed through state and federal law.

Based on the needs of the child, as identified in the IEP, placement should be made in a program which is as much like the standard programs for other children as possible. Special classes and separate schools should be placement considerations only when the nature, severity or complexity of your child’s handicap prevents achievement of a satisfactory education program in a regular class.

If it is determined in the multi-disciplinary conference that your child’s educational needs cannot be met through a public school special education program, the school district must provide an appropriate and the least restrictive environment.

Special educational instructional programs and related services are available to handicapped children between the ages of 3 and 21 who are enrolled in the local school district. Both parents and students shall be aware that special education services terminate following the granting of a diploma.
